Real Estate Appraiser Website

This Real Estate Appraiser Web Site Agreement ("Agreement") is by and between Pacifica Endeavors Endeavors LLC ("Pacifica Endeavors Endeavors"), a California Limited Liability Corporation, and you, your heirs, assigns, agents and contractors ("You") and is effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your Real Estate Appraiser Website (collectively, the "Site") and represents the entire agreement between You and Pacifica Endeavors. By using the Services, You acknowledge that You have read, understand and agree to be bound by all the terms and conditions of this Agreement, along with any new, different or additional terms, conditions or policies, including the Universal Terms of Service which Pacifica Endeavors may establish from time to time. Such Agreements may be found here.

In addition to transactions entered into by You on Your behalf, You also agree to be bound by the terms of this Agreement for transactions entered into on Your behalf by anyone acting as Your Agent, and transactions entered into by anyone who uses the account You've established with Pacifica Endeavors, whether or not the transactions were in Your behalf.

Description of Service

Pacifica Endeavors currently provides the Site to its customers for a one-time set-up fee and monthly fee. Pacifica Endeavors will host Your Site on third-party servers offering commercial web hosting services.

Internet Visibility

Pacifica Endeavors will optimize Your Site for Internet search engines on a best efforts basis. You agree that it may take several months for Your Site to be displayed within the first three pages of search engine returns for targeted keywords based on the competitiveness of these keywords within Your targeted geographical area. Pacifica Endeavors cannot guarantee Your Site will be prominently displayed in search engine returns, but Pacifica Endeavors will use reasonable efforts to achieve this result. You agree to utilize materials provided by Pacifica Endeavors to create incoming hyperlinks to Your Site and recognize that this is an essential requirement for improving search engine ranking.

License of Your Site content

Pacifica Endeavors grants to You, and You accept from Pacifica Endeavors, a non-exclusive, worldwide and royalty free license to display Your Site content in connection with Pacifica Endeavors' Services.

Availability of Services

Subject to the terms and conditions of this Agreement and the third-party hosting service, Pacifica Endeavors shall attempt to provide the Services for twenty-four (24) hours a day, seven (7) days a week throughout the term of this Agreement. You agree that from time to time the Services may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs that Pacifica Endeavors or the third-party hosting service may undertake from time to time; or (iii) causes beyond the control of Pacifica Endeavors or that are not reasonably foreseeable by Pacifica Endeavors, including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks network congestion or other failures. You agree that Pacifica Endeavors has no control of availability of the Services on a continuous or uninterrupted basis.

Service Availability Guarantee

The third-party hosting service used by Pacifica Endeavors offers a service uptime guarantee for the Services of 99.9% ("Service Uptime") of available time. Pacifica Endeavors is not responsible nor does it guarantee claims by the third-party service.

Backup

Pacifica Endeavors shall use commercially reasonable efforts to maintain a backup copy of Your Site throughout the term of this Agreement. Pacifica Endeavors shall use reasonable efforts to restore your Site if the content is lost, but You agree that Pacifica Endeavors is not responsible for actions taken by the the third-party hosting vendor..

Site Ownership

Pacifica Endeavors is the sole owner of the Site and has copyright rights to the Site design and template. You own the domain name and Site content provided by You. If You cease paying the monthly subscription fee, the Site will be discontinued. Upon discontinuing the Services, You may purchase the Site from Pacifica Endeavors for use with Your own real estate appraisal business only. You agree you have neither resell rights nor license rights to the Site.

Materials and Guides Ownership

You agree that any materials or guides provided to You by Pacifica Endeavors are the copyrighted property of Pacifica Endeavors.
